The Patent Act and The Development of Stem Cell Research in Indonesia (Is A Patent System The Only Legal Instrument To Develop Stem Cell Research?)

This research discusses the possibility of patenting stem cells under the Indonesian patent law by focusing on two essential issues: a) what approaches or patent related policies should be chosen by the Indonesian Government as model to develop stem cell research? b) what barriers or gaps need to be resolved to meet its public responsibility?

This research attempts to examine the relation between the patent protection on stem cells and the developing of stem cell research in Indonesia. In doing so, this paper describes the experience and policies of the USA, German and South Korean Governments in developing stem cell research under patent law and in handling the impact of stem cell research on society. Such information will help the Indonesian government to consider several policies dealing with the development of stem cell research under a patent system in the future. This paper concludes that stem cell patent regulation is not the only factor developing stem cell research in Indonesia. Use of patent law alone is insufficient to solve the problems of stem cell research development.
