CLIP is a group of scholars in the fields of intellectual property and private international law. It was established in 2004 and meets regularly to discuss issues of intellectual property, private international law and jurisdiction.

The Group’s goal is to draft a collection of principles for conflict of laws in intellectual property and to provide independent advice to European and national lawmakers. The Group is funded by the Max Planck Society.

The purpose of this document is to provide input for the report to be prepared by the Commission on the functioning in practice of the Brussels Regulation on Jurisdiction and Enforcement of Foreign Judgments in Civil and Commercial Matters (the Regulation), and to submit proposals for amendment (see Art. 73 of the Regulation).

Es erscheint notwendig, den Antworten zum Dokument der EG Kommission, „Stakeholder Consultation on Copyright Levies in a Converging World“ vom Juni 2006 eine Reihe von allgemeinen Bemerkungen voranzustellen, damit der allgemeine Zusammenhang und Zweck von gesetzlichen Vergütungsansprüchen, die in diesem Dokument behandelt werden, nicht aus dem Auge verloren wird.

Erstens ist das Dokument unklar in Bezug auf die Art der angesprochenen Vergütungsansprüche: Es benutzt die Worte „Copyright Levies“ und scheint sich damit auf die Vergütung für alle Arten von Nutzungen im Bereich des Urheberrechts (und wahrscheinlich auch im Bereich der verwandten Schutzrechte, obwohl dies nicht genau angegeben wird) zu beziehen. Gleichzeitig scheint das Dokument selbst auf die Vergütung für die private Vervielfältigung beschränkt zu sein. In diesem Zusammenhang sollte angemerkt werden, dass viele Mitgliedstaaten eine Reihe von gesetzlichen Vergütungsansprüchen nicht nur in Bezug auf die private Vervielfältigung, sondern auch in Bezug auf andere Nutzungen, die durch das Gesetz erlaubt werden, vorsehen. Dieser in sich widersprüchliche Gebrauch von Begriffen im Dokument der Kommission scheint auf gewisse Defizite in Bezug auf das allgemeine Verständnis des Konzepts der gesetzlichen Vergütungsansprüche, so wie sie im nationalen Recht der Mitgliedstaaten bestehen, hin zu deuten.

The Max Planck Institute hereby submits its comments on the DG Competition discussion paper on the application of Article 82 of the EC Treaty to exclusionary abuses. Although some remarks will be made on the general analytical framework envisaged for exclusionary abuses, the focus of these comments will be on the Commission’s approach to exclusionary abuses involving intellectual property rights.

Ausweislich der Begründung dient der Referentenentwurf eines Gesetzes zur Verbesserung der Durchsetzung von Rechten des geistigen Eigentums des Bundesministeriums der Justiz (Stand: 3. Januar 2006) vor allem der Umsetzung der Richtlinie 2004/48/EG des Europäischen Parlaments und des Rates vom 29. April 2004 zur Durchsetzung der Rechte des geistigen Eigentums in das deutsche Recht. Darüber hinaus soll das deutsche Recht an die Grenzbeschlagnahmeverordnung Nr. 1383/2003 des Rates vom 22. Juli 2003 angepasst sowie eine Strafbarkeitslücke im Markengesetz geschlossen werden.

Das Max-Planck-Institut für Geistiges Eigentum, Wettbewerbs- und Steuerrecht beschäftigt sich im Rahmen einer Arbeitsgruppe intensiv mit der Zukunft der Verwertungsgesellschaften und der zukünftigen Gestaltung des Wahrnehmungsrechts in der Europäischen Union. Unser Institut hat insbesondere die Stellungnahme der Bundesregierung zum Mitarbeiterpapier der Kommission vom 7. Juli 2005 zur Kenntnis genommen. Die Auffassung der Bundesregierung wird von uns durchgehend geteilt. Die folgenden Ausführungen beschränken sich auf eine Evaluierung der Rechtspolitik der Kommission und eine Empfehlung für das weitere Vorgehen der Bundesregierung.
